These Terms and Conditions ("Terms") govern the provision of the Property Insight Report ("Report") by ATA Development ("we," "us," or "our") to you ("Client" or "you"). By receiving or using this Report, you agree to these Terms.
1. Scope of Services
• The Report is a preliminary desktop assessment based on publicly available information and is intended for informational purposes only. It does not constitute professional advice, including but not limited to building inspections, town planning, engineering, legal, financial, or valuation services.
• While we strive to ensure all presented information is correct and current, we provide no representations or warranties regarding its accuracy, completeness, or suitability. You must independently verify all details with qualified professionals and local authorities before proceeding with any decisions.
2. Limitations and Disclaimers
• No Liability: To the fullest extent permitted by law, ATA Development and its affiliates, employees, or agents disclaim all liability for any loss, damage, or expense arising from your use of or reliance on the Report, including indirect, consequential, or incidental damages.
• Data Currency: Information is current as of the Report date and subject to change.
• Intellectual Property: The Report is our confidential property. You may not reproduce, distribute, or use it for commercial purposes without our written consent.
3. Payment and Refunds
• Payment for the Report is non-refundable after delivery, except within 48 hours of purchase if no sites have been reviewed. All prices include GST and are for Queensland properties only.
• Each order will expire 30 days from the order date. Meaning If you order 3 reports and do not use them within 30 days, you will need to place a new order.
4. Build Offer*
• This Report serves as a valid receipt for a $3,000 discount on any building services (e.g., construction of granny flat, new house builds, knock down rebuild, custom build, rooming house, NDIS, construction of projects) contracted with ATA Development within 12 months of the Report date of the specific property in this report.
• To redeem: Present this Report during your build consultation. The discount applies to the total build contract value (minimum $150,000) and cannot be combined with other promotions. It is non-transferable and subject to availability. We reserve the right to verify eligibility.
• This incentive is our way of rewarding your trust—let's turn insights into your dream build!
5. Governing Law
• These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland.
6. Acceptance and Changes
• Your continued use of the Report implies acceptance of these Terms. We may update them at any time; the latest version applies.
